General Terms and Conditions (AGB)

1. Scope
1.1 These General Terms and Conditions (GTC) apply to all contracts between F+K Solar GbR, Dorfstraße 34, 74594 Kreßberg, and the customer—regardless of whether the customer is a consumer (§ 13 BGB) or a business (§ 14 BGB)—for the sale, delivery, installation, and commissioning of photovoltaic systems including accessories.

1.2 Any differing or additional terms and conditions provided by the customer shall only apply if F+K Solar expressly agrees to them in writing.

2. Conclusion of Contract
2.1 Offers on the website are non-binding—a contract is only concluded through explicit acceptance (e.g., written order confirmation or the start of installation).

3. Services & Customer Cooperation
3.1 The scope of services (e.g., installation, commissioning) is defined in the service description and the individual offer.

3.2 The customer must ensure that the installation site is accessible, structurally suitable, approved, and free from hazardous materials (e.g., asbestos—as noted by Gelb Solar), and must provide structural proof if necessary.

4. Prices and Payment
4.1 The agreed fixed prices plus VAT apply.

4.2 Payments are made according to the agreement (e.g., down payments, final invoice); discounts (Skonto) only apply if expressly agreed.

4.3 In case of payment delay, interest on arrears will be charged at a rate of 9 percentage points above the base interest rate.

5. Delivery & Installation
5.1 Deadlines depend on availability and customer cooperation.

5.2 If the customer fails to cooperate, resulting in delays, the deadlines will be extended accordingly.

6. Retention of Title
The system remains the property of F+K Solar until full payment has been made.

7. Warranty
Statutory warranty rights apply (§§ 434 ff. BGB). The customer must report any defects in writing without delay.

8. Liability
8.1 F+K Solar is fully liable for intent and gross negligence.

8.2 For simple negligence, liability is limited to breaches of essential contractual obligations (cardinal duties) and restricted to typical, foreseeable damages.

8.3 Further liability, particularly for loss of profit, is excluded.

9. Right of Withdrawal (for Consumers)
Consumers have a statutory right of withdrawal (14-day period; details provided in the withdrawal notice or order confirmation).

10. Inclusion of Terms and Conditions
These GTC are part of the contract if the customer was expressly informed of them before the contract was concluded, they were made accessible, and their validity was confirmed (e.g., via checkbox).

11. Final Provisions
11.1 German law applies. In consumer contracts, the statutory place of jurisdiction generally applies.

11.2 If any individual provisions are or become invalid, the remainder of the contract remains valid (severability clause).
